Privacy Commitment

The Behavioral Health Association of Providers ("BHAP" or "we" or "us") understands your privacy is important. We protect privacy in a variety of ways including using industry-standard security measures to protect against the loss, misuse, unauthorized access, or alteration of data used by our system. We take the responsibility of protecting the privacy of our individual members and their organization's owners, operators, employees, contractors, staff, volunteers, and other agents that may utilize the membership services of BHAP ("Members") and of visitors to our website and participants in our sponsored events (collectively "you" or "your") very seriously. For this reason, we have created this privacy policy (the "Privacy Policy") to help you understand how we collect, use, and protect the information we collect from you.

This Privacy Policy is binding agreement between you and BHAP. This policy may change at BHAP's discretion and any changes are effective as of the date of posting to BHAP's website (www.bhap.us) or actual notice to you, whichever is earlier. Your continued use of the website, receipt of BHAP's emails and other communications, or participation in sponsored events (collectively "BHAP Resources") after the posting of any changes will constitute your acceptance of those changes.

Information We Collect and How We Use It

INFORMATION YOU PROVIDE TO BHAP: We receive and store any information you enter on our website, provide us in the membership registration process, or give us by phone, email, or in any other way. We may use the information you provide to respond to your requests, communicate with you, provide information about BHAP resources and product/service offerings, send promotional material on behalf of partners, and customize and improve our website and services. To purchase membership, Members must submit credit card information in addition to certain personal information, which we use to bill Members for membership annually. If you would like to opt-out of communications or other services using the information you have provided, please contact us by phone at (888) 958-2282 or by email at help@bhap.us, or by accessing your online account profile at www.bhap.us.

COOKIES: BHAP's website uses cookies to optimize your experience. Cookies are small text files stored by the browser on your computer or other device. Websites like BHAP's place cookies on visitors' computers or other devices to collect information about visitors to the site, which we may then use to identify Members during sign-in, deliver targeted content and advertising, conduct research and diagnostic activities, improve functionality and security, and facilitate BHAP's services. Cookies may involve the transmission of information from us to you and from you directly to us or to another party on our behalf in accordance with this Privacy Policy. Through your browser settings, you can elect to have your device warn you each time a cookie is being sent or to turn off all cookies. If you turn cookies off, you may not have access to many features and/or some of the resources on our website may not function properly.

OTHER INFORMATION FROM THE BHAP WEBSITE: BHAP's website uses analytics software including, without limitation, Google Analytics, for research, diagnostic, and advertising purposes. Similar to cookies, Google Analytics and similar software collect and store data about website visitors. BHAP uses such analytical software to understand visitors' preferences so that we can improve users' experience, develop relevant content, and offer targeted advertising in accordance with this Privacy Policy. You can use a browser plugin to opt out of all Google Analytics tracking software. Disabling analytical software may mean that you do not have access to many features and/or some of the resources on the BHAP website may not function properly.

BHAP's website also utilizes security software and features that collects and stores information on users in order to protect the website and databases from deleterious programming routines. BHAP reserves the right to block access from any IP address which contains or has contained, whether intentionally or unintentionally, any programming routines that may be determined as unsafe.

BHAP COMMUNICATIONS: We may email Members about legislative updates, advocacy alerts, breaking news, and other information we believe is relevant to Members. We also email Members with updates about their membership, including auto-renewal notices. Members may opt-out of receiving informational and/or promotional emails or other communications from us and our partners. Note that if you opt-out of our informational and/or promotional emails but you purchased a membership from us, you will continue to receive communications from us about your membership.

Sharing Your Information

THIRD-PARTY PARTNERS: We do not sell, rent, loan, trade, or lease your information to third-parties. However, we do partner with third-party partners to offer promotional materials, goods, and/or services and advertising directly to Members. These promotions and advertisements will be sent directly by and from BHAP, and our partners will not receive your information unless you choose to directly provide it to them.

THIRD-PARTY SERVICE PROVIDERS: We may employ other companies and persons to perform certain business functions on our behalf including, but not limited to, website development and maintenance, marketing, accounting, and payment processing. These third parties have access to user information needed to perform their functions, but they may not use it for any other purposes.

LEGAL PURPOSES: We may disclose your information if required to do as required by law. In addition, notwithstanding any terms to the contrary in this Privacy Policy, we retain the right to use, disclose, and/or share your information to investigate, prevent, or take any other action relating to illegal activities, suspected fraud, and situations involving potential threats to the physical safety of any person.

WITH YOUR PERMISSION: For situations other than those described in this Privacy Policy, we will notify you when personally identifiable information might be disclosed to a third party and you will have the ability to opt-out of sharing your information.

Miscellaneous

APPLICABLE LAW AND CHOICE OF FORUM

By visiting our website, you agree that any dispute relating to or arising out of this Privacy Policy shall be subject to the laws of California, USA. All claims arising out of or relating to the Privacy Policy, BHAP membership, or the use of BHAP Resources will be litigated exclusively in the federal or state courts of Los Angeles County, California, USA. By using this website or other BHAP Resources, you consent to personal jurisdiction in those courts.
